Pune, 28 November 2021: Complex rules have been simplified so that the Unified Development Control and Promotion Regulations become both development-oriented and people-oriented, benefiting the entire population, said Eknath Shinde, Minister of Urban Development and Public Works – GoM. Since the introduction of the unified DCR, all stakeholders – planners, developers and architects – have already tried to maximise the potential of the new rules. Over the next two years, we will see how the vision of this landmark legislation for a better and brighter metropolitan area of Mumbai and Maharashtra will be realized. Shinde said: “The unified DCPR approved last year did not solve the problem of Thane residents. Under the revised rules, the approved ISP (1.1) + 0.5 Premium ISP + Eligible RDT + 60% additional ISP is given for general refurbishment, while the Approved ISP (1.1) + 0.5 Premium ISP + 50% Incentive ISP + Eligible RDT + 60% Additional ISP are given for hazardous building rehabilitation. In addition, narrow streets of 9 m are considered 12 m and the height of the building is approved up to 70 m. The Maharashtra Unified Development Control and Promotion Regulations (DCPR or DCR), which came into force in December 2020 and gave much-needed positivity to the state`s housing sector, will continue to ensure systematic and sustainable urban development in the coming years. The 397-page document of the new rules comprehensively covers all aspects of infrastructure and real estate development in the reported urban areas, bringing the uniformity, consistency and transparency needed to a sector that has always been characterised by ambiguous standards and opaque processes. Maharashtra could have uniform development control rules for local bodies in the RMM. The new DCR involves far-reaching reforms for the development of specific spaces in urban areas that were previously largely ignored and vulnerable to unlawful interference – from the approval of cycle lanes and recreational areas in green belts and coastal areas to the development of public spaces on reserved land.
The biggest impact of the rules will be seen in private developments in the public real estate sector. In addition to Pune and Kolhapur, the cities of the Mumbai Metropolitan Region (MMR), Thane, Navi Mumbai and Kalyan-Dombivali are at the forefront of this new wave of development. Improved ISF rules will not only give a big boost to new developments on smaller plots with a limited basic ISS, but will also be a boon for hundreds of thousands of old buildings and companies ripe for renovation. While local citizen authorities and the state government can generate additional revenue by sharing the FSI premium on a 50:50 basis, lakhs of residents living in obsolete and unsafe buildings will now be able to rehabilitate their premises independently or through a reputable developer with the expertise and experience to carry out such projects. Magar said that when creating a rules and regulations manual, care must be taken that it is implemented quickly so that it is easier for the manufacturer to pass on its benefits to people. The new DCR has not only taken into account virtually all aspects of urban development in the areas reported, but has also demonstrated a thorough understanding of microfactors and introduced specific standards and reforms for purpose-built cities. For example, the future metro network in Thane will have a significant footprint on the city`s domestic and intercity travel. Similarly, the new standards for Navi Mumbai have taken into account the need to allow the renovation of old CIDCO buildings as well as private housing cooperative associations and to give a green signal for all buildings over 30 years old, regardless of their current state. This is a great relief for the city, given years of uncertainty about checking the dangerous condition of buildings. Another rule specific to Navi Mumbai is to consider the street width of 11 meters in the planned urban area of the city at eye level with the street width of 12 meters for any purpose, including the permitted uses mentioned in this unified DCPR. This is another anomaly that has resulted in many buildings on nine-metre-long internal roads narrowly missing out on qualifying for a higher TFR. Special provisions for the merger of businesses and land will further promote urban renewal and development in the satellite city.
